Terms of use

These terms govern the use of the Miftahly platform operated by RWAD (Muscat, Sultanate of Oman). By creating an account or using the platform, the office agrees to these terms and to the privacy policy.

Account

  • The office keeps its registration details accurate and up to date, and protects passwords and two-step sign-in devices.
  • The office grants staff permissions under its own responsibility and is responsible for what they do in its account.
  • Every action in the system is recorded with who did it and when.
  • Platform users must be at least 18 years old.

Subscription, trial and payment

  • Every office starts with a free trial for the period shown on the pricing page.
  • After the trial the office picks a plan; the price depends on the number of cars in the fleet. Listed prices exclude VAT; VAT is added and invoices are issued under Oman's VAT law.
  • The price stays fixed for the paid subscription period. Any price change applies from the next renewal, after notifying the office.
  • If payment is late beyond the grace period, the account becomes read-only and then suspended, without deleting data.
  • A subscription runs until the end of the paid period, and amounts for a period that has started are not refunded, unless the law provides otherwise.

Data and processing on the office's behalf

The office's data and its customers' data belong to the office, which is legally responsible for it. RWAD processes it on the office's behalf, under its instructions, and only to provide the service.

RWAD's commitments

  • Confidentiality, with access limited to team members who need it to provide the service or support.
  • Appropriate security measures, including encryption, separation between offices and backups.
  • Using only the service providers listed in the privacy policy, under contracts requiring the same protection.
  • Notifying the office of any incident affecting its data within 72 hours of becoming aware of it.
  • Helping the office respond to data subjects' requests.

The office's commitments

  • Obtaining each customer's explicit consent before storing their data, including consent to storage outside Oman. The platform provides the consent text and records it.
  • The accuracy of the data and documents it enters and the lawfulness of collecting them.
  • Responding to its customers' requests about their data; it can export its data at any time.

Electronic signatures

Customer signatures on contracts in the platform are kept as electronic records with their time and contract details, under the Electronic Transactions Law (Royal Decree No. 69/2008). The office remains responsible for verifying the signer's identity.

Artificial intelligence

Document reading and inspection photo analysis are suggestions to help. The final decision on damage and amounts belongs to the responsible employee, and no amount is charged to a customer without staff approval. RWAD is not liable for a decision not reviewed by staff.

Acceptable use

It is not allowed to:

  • Use the platform for any activity that breaks the laws of Oman.
  • Try to access another office's data, or test the platform for vulnerabilities without written permission.
  • Disrupt the service or load it beyond normal use.
  • Resell or copy the platform.

Intellectual property

The platform, its software, design and brand belong to RWAD. The office receives a non-exclusive right of use for the subscription period, and no ownership right passes to it.

Availability and support

We work to keep the service available with daily backups; it may pause for short maintenance windows announced in advance where possible.

Ending a subscription

  • The office may end its subscription at any time; the account stays active until the end of the paid period.
  • RWAD may suspend an account for a serious breach of these terms, after notifying the office and giving a reasonable period to fix it, unless the breach threatens the platform's security or other offices' data.
  • After it ends, the data stays available for export or reactivation, and the office may ask for permanent deletion at any time, except data the law requires us to keep.

Limitation of liability

The platform is provided as a business management tool. To the extent permitted by law, RWAD is not liable for indirect damage or loss of profit, and its total liability does not exceed the subscription fees paid by the office in the twelve months before the claim.

Force majeure

Neither party is liable for delay or failure caused by circumstances beyond its control, such as disasters, general telecom outages or government decisions.

Changes

We may update these terms and will notify offices of any material change at least thirty days before it takes effect. Continued use after that date means acceptance.

Governing law and disputes

These terms are governed by the laws of the Sultanate of Oman. The parties will try to settle any dispute amicably within 30 days; otherwise it goes to the competent courts in Muscat.

Language

These terms are issued in Arabic and English; if they differ, the Arabic text prevails.
